These Terms & Conditions ("Terms") govern your access to and use of the Settle in Thailand platform, including our website, AI assistant ("Phad"), interactive calculators and tools, relocation and visa guidance content, school comparison resources, community or forum functionality, emails, APIs, and any affiliated partner referral or introduction services (collectively, the "Services"). By accessing or using any part of the Services you agree to be bound by these Terms. If you do not agree, you must not use the Services.

Definitions

• "We", "us", "our" means the operator(s) of the Settle in Thailand platform and associated legal entity or entities.
• "User", "you" means any individual or entity accessing or using the Services.
• "AI Assistant" or "Phad" refers to automated conversational or generative functionality provided within the Services.
• "Partner" or "Affiliate" means any third-party provider of products or services to which we link, refer, or introduce users (e.g., visa agents, insurance, property, education, financial or relocation service providers).
• "Content" means text, data, articles, tools output, code, audio, video, images, or other material available through the Services (including user-generated content).

Scope of Services

The Services provide general informational resources, planning aids, comparative tools, aggregated or derived data (including cost of living indices), and AI-assisted conversational responses intended to help people considering relocating to or living in Thailand. We do not provide regulated professional services (including but not limited to immigration agency work, legal representation, accounting, tax advisory, investment advice, medical or psychological services). Any introductions or referrals to Partners are provided solely for convenience and do not constitute endorsement, certification, or guarantee of suitability. All final decisions remain your responsibility.

Use of Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not (a) attempt to gain unauthorized access to any system; (b) probe, scan, overload, or disrupt infrastructure; (c) copy, scrape, harvest, or mass-download data except via clearly provided export features; (d) reverse engineer or attempt to extract source code of proprietary components; (e) use automated scripts, bots, or similar methods to query, submit, or interact beyond normal human usage patterns; (f) use the Services to develop, train, or improve competing datasets or AI models without our prior written consent; (g) submit or transmit any malicious code; (h) use the Services in violation of applicable law (including immigration, data protection, anti-spam, and consumer protection laws); or (i) misrepresent your identity or affiliation. We may suspend or terminate access for violations or suspected abuse without liability.

The AI Assistant generates outputs probabilistically and may produce errors, outdated references, partial interpretations, or hallucinated content. You must critically evaluate results before relying on them. Prompts you supply may be used (in anonymized or aggregated form) to improve quality, safety, and reliability consistent with our Privacy Policy.

• No AI output constitutes legal, financial, medical, tax, investment, immigration, or other regulated professional advice.
• You remain responsible for verifying visa eligibility, compliance requirements, school enrollment conditions, insurance suitability, and financial decisions with qualified professionals.
• We may throttle, rate-limit, or modify access for quality, security, or performance reasons.

Information Accuracy & Professional Advice Disclaimer

We strive for accuracy and freshness of Content (including regulatory timelines, costs, budgets, and education or visa pathway summaries) but cannot guarantee completeness, correctness, currentness, or suitability. Regulatory frameworks in Thailand change frequently and sometimes without advance public notice. All Content is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind—express, implied, or statutory—including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non-infringement. You assume full responsibility for how you interpret and use any output or guidance. Always consult appropriately licensed or certified professionals before acting on critical decisions.

Affiliate & Partner Disclosures

Some pages, tools, emails, or AI responses may include links to or introductions for Partners. We may receive compensation (e.g., referral fees, affiliate commissions, sponsored placement, or revenue sharing) if you engage a Partner, sign a contract, purchase a product, or complete an application. Such compensation helps fund the Services and does not increase your cost (where prohibited it is adjusted accordingly). We aim to present Partners based on relevance, quality indicators, and user value; compensation may influence order or selection but does not override our commitment to transparency.

• We do not control, operate, or guarantee Partner sites, staff, processes, pricing, service levels, or outcomes.
• Engagement with any Partner is solely between you and that Partner under their own terms and policies.
• We are not a party to and have no responsibility for disputes, refunds, delays, errors, or losses arising from Partner interactions.

Liability & Indemnity

To the maximum extent permitted by law, we (and our directors, officers, employees, contractors, licensors, data providers, and agents) shall not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or lost profit damages; nor for loss of data, business interruption, corruption, opportunity, goodwill, or anticipated savings; nor for reliance losses arising out of or related to your use of (or inability to use) the Services or any Content or Partner interaction—even if advised of the possibility of such damages. Our aggregate liability for any claim arising out of or relating to the Services shall not exceed the greater of (a) the total fees, if any, you paid us specifically for the paid portion of the Services giving rise to the claim during the three (3) months preceding the event, or (b) USD 50 (or equivalent).

You agree to indemnify, defend, and hold harmless us and our affiliates from and against any claims, losses, liabilities, damages, expenses, and costs (including reasonable legal fees) arising out of or related to (i) your misuse of the Services, (ii) your violation of these Terms or applicable law, (iii) your Content or data you submit, (iv) any dispute with a Partner, or (v) infringement or misappropriation of any intellectual property or privacy right caused by your conduct.

Nothing in these Terms excludes liability that cannot be excluded under applicable law (such as for gross negligence or wilful misconduct where mandated). Some jurisdictions do not allow certain disclaimers; where prohibited, those disclaimers shall not apply solely to the extent of the prohibition.

Privacy & Data Handling

Collection, processing, storage, and sharing of personal data are governed by our separate Privacy Policy, which is incorporated by reference. By using the Services you acknowledge review of the Privacy Policy and consent to practices described therein, including limited usage of anonymized or aggregated data for analytics, model improvement, fraud prevention, service optimization, and product development. We may use cookies, local storage, pixels, logs, and similar technologies for authentication, personalization, usage analytics, performance monitoring, and affiliate attribution. Where required, consent banners or preference mechanisms are provided. Do not submit sensitive personal data (e.g., passport numbers, full medical records) unless explicitly requested for a defined feature with clear safeguards.

If you participate in community or forum features you understand that posted content may become publicly visible or visible to other registered users; you are solely responsible for what you share.

Community / User Content Rules

Where commenting, posting, or contribution functionality exists, you agree not to upload or distribute content that is illegal, defamatory, infringing, harassing, hateful, deceptive, pornographic, exploitative, or otherwise objectionable; or that contains personal data of others without authorization; or that constitutes commercial solicitation, spam, or unauthorized marketing. We may (but are not obligated to) moderate, remove, filter, or restrict content or accounts at our discretion. You retain ownership of your original contributions but grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, adapt, publish, translate, display, distribute, and create derivative works for operation, improvement, promotion, archival, and backup of the Services. You represent that you have all rights necessary to grant this license.

Intellectual Property

All proprietary rights, title, and interest in and to the Services (including underlying software, design systems, layouts, databases, compiled cost indices, AI prompt engineering methods, trade names, trademarks, logos, domain names, look-and-feel, and non-user-generated Content) remain with us or our licensors. Except for limited access rights expressly granted, no license or transfer of intellectual property is implied. You must not remove trademarks, copyright notices, or proprietary legends. Any feedback or suggestions you provide may be used by us without restriction or obligation, and you hereby assign (or agree to assign) all associated rights to the extent permitted by law.

Changes to Terms & Services

We may update these Terms, modify features, introduce new elements, impose or revise limits, or discontinue any part of the Services at any time. Material changes will be signaled by updating the "Last updated" date and, where feasible, by notices (e.g., banner, email, in-product message). Continued use after changes constitutes acceptance of the revised Terms. If you object to changes, your sole remedy is to discontinue use and, where applicable, request account deletion in accordance with the Privacy Policy.

Governing Law & Dispute Resolution

These Terms and any dispute or claim (contractual or non-contractual) arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to conflict-of-law principles. Parties shall first attempt in good faith to resolve disputes informally within thirty (30) days. If unresolved, either party may refer the dispute to confidential arbitration seated in Bangkok under rules of a recognized arbitral institution mutually agreed (failing agreement, the Thai Arbitration Institute), with proceedings in English unless otherwise required. Either party may seek injunctive or equitable relief in any competent court for protection of intellectual property or confidential information pending final resolution.

Severability & Miscellaneous

• Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and an enforceable term will be substituted reflecting original intent as closely as permitted.
• No Waiver: Failure to exercise or enforce any right does not constitute a waiver of that right.
• Assignment: You may not assign or transfer these Terms without our prior written consent; we may assign to an affiliate or in connection with a merger, acquisition, or asset transfer.
• Force Majeure: We are not liable for any delay or failure due to causes beyond our reasonable control (including natural disasters, labor disputes, power failures, network outages, governmental actions, war, pandemic, civil unrest, or supplier failures).
• Entire Agreement: These Terms (together with referenced policies like the Privacy Policy) constitute the entire agreement between you and us regarding the Services and supersede prior understandings.
• Interpretation: Headings are for convenience only and shall not affect construction. Terms like "including" are deemed to mean "including without limitation".
• Language: Where these Terms are translated, the English version governs in case of inconsistency unless mandatory local law dictates otherwise.
